2. Scope of Application

These Terms & Conditions govern the sale of products offered on www.derutaitaly.com.

By placing an order on this website, the customer agrees to be bound by these Terms & Conditions, the Shipping, Returns & Replacements Policy, and the Privacy & Cookie Policy, which together form the contract of sale.

3. Products

All products sold on derutaitaly.com are handcrafted ceramic items made in Italy.

Due to the artisanal nature of the production process, minor variations in color, shape, size, or decoration may occur. These variations are a natural characteristic of handmade products and shall not be considered defects.

Product images are for illustrative purposes only.

4. Orders

  • Orders are considered accepted only after confirmation by email.

  • Maioliche Originali Deruta S.A.S. reserves the right to refuse or cancel any order in case of product unavailability, pricing errors, or suspected fraudulent activity.

  • In case of cancellation, the customer will receive a full refund.

5. Prices and Payments

  • Prices are displayed in EUR or USD, depending on customer selection.

  • Prices include VAT where applicable.

  • For shipments outside the European Union, customs duties, import taxes, and clearance fees are the sole responsibility of the customer.

  • Accepted payment methods are displayed during checkout.

6. Shipping and Delivery

Shipping methods, costs, destinations, and estimated delivery times are described on the Shipping, Returns & Replacements page.

Delivery times are indicative only.
The seller is not responsible for delays caused by couriers, customs procedures, or force majeure events.

7. Damaged or Incorrect Items

Customers must inspect the goods upon delivery.

If an item is received damaged or incorrect, the customer must contact the seller within 14 days of delivery, providing:

  • order number;

  • customer name;

  • description of the issue;

  • clear photos of the damaged item and packaging.

Returns must be authorized in advance. Unauthorized returns will not be accepted.

8. Returns, Replacements and Refunds

Returns, replacements, and refunds are governed by the Shipping, Returns & Replacements Policy, which is an integral part of these Terms & Conditions.

When a return is accepted, customers may choose:

  • replacement of the item;

  • store credit;

  • refund of the original purchase price.

Refunds of return shipping costs and customs duties are issued only in cases of damaged or incorrect items.

9. Right of Withdrawal (EU Customers)

EU customers have the right to withdraw from the purchase within 14 days from delivery, in accordance with EU law.

The right of withdrawal does not apply to:

Con l’invio dell’ordine, il cliente accetta integralmente i presenti Termini e Condizioni, la Shipping, Returns & Replacements Policy e la Privacy & Cookie Policy, che costituiscono il contratto di vendita.

3. Prodotti

I prodotti venduti sono ceramiche artigianali realizzate a mano in Italia.

Eventuali lievi differenze di colore, forma o decorazione sono da considerarsi caratteristiche proprie del prodotto artigianale e non costituiscono difetto.

Le immagini hanno valore puramente illustrativo.

4. Ordini

  • Gli ordini si considerano accettati solo dopo conferma via email.

  • Il venditore si riserva il diritto di annullare ordini in caso di indisponibilità, errori di prezzo o sospetta frode.

  • In caso di annullamento, l’importo verrà rimborsato integralmente.

5. Prezzi e pagamenti

  • I prezzi sono indicati in EUR o USD.

  • I prezzi includono l’IVA ove applicabile.

  • Per spedizioni extra UE, dazi e tasse doganali sono a carico del cliente.

  • I metodi di pagamento disponibili sono indicati al checkout.

6. Spedizione e consegna

Modalità, costi e tempi stimati di consegna sono indicati nella pagina Shipping, Returns & Replacements.

I tempi sono indicativi.
Il venditore non è responsabile per ritardi dovuti a corrieri, dogana o cause di forza maggiore.

7. Prodotti danneggiati o errati

Il cliente deve verificare la merce alla consegna.

Eventuali danni o errori devono essere segnalati entro 14 giorni, fornendo:

  • numero d’ordine;

  • descrizione del problema;

  • fotografie del prodotto e dell’imballo.

I resi devono essere preventivamente autorizzati.

8. Resi, sostituzioni e rimborsi

Resi e rimborsi sono regolati dalla Shipping, Returns & Replacements Policy, parte integrante dei presenti Termini.

In caso di reso accettato, il cliente può scegliere tra:

  • sostituzione;

  • credito negozio;

  • rimborso dell’importo pagato.

Le spese di reso e i dazi doganali vengono rimborsati solo in caso di prodotto danneggiato o errato.

9. Diritto di recesso (clienti UE)

Il cliente UE ha diritto di recesso entro 14 giorni dalla consegna, salvo eccezioni di legge.

Il recesso non si applica a:

  • prodotti personalizzati;

  • prodotti danneggiati dopo la consegna;

  • resi non autorizzati.

Le spese di restituzione sono a carico del cliente.

10. Limitazione di responsabilità

Il venditore non risponde di:

  • uso improprio dei prodotti;

  • danni indiretti;

  • ritardi per cause di forza maggiore;

  • errori tipografici.

La responsabilità è limitata all’importo dell’ordine.

11. Proprietà intellettuale

Tutti i contenuti del sito sono di proprietà di Maioliche Originali Deruta S.A.S.
È vietata qualsiasi riproduzione non autorizzata.

12. Legge applicabile e foro competente

I presenti Termini sono regolati dalla legge italiana.
Foro competente: Perugia.

13. Versione prevalente

In caso di discrepanze tra la versione italiana e quella inglese, prevale la versione inglese.

10. Limitation of Liability

Maioliche Originali Deruta S.A.S. shall not be liable for:

  • improper use of the products;

  • indirect or consequential damages;

  • delays due to force majeure;

  • typographical or technical errors.

Liability is limited to the total amount paid for the order.

11. Intellectual Property

All content on this website is the exclusive property of Maioliche Originali Deruta S.A.S.
Any unauthorized use is prohibited.

12. Governing Law and Jurisdiction

These Terms & Conditions are governed by Italian law.
Any dispute shall be subject to the exclusive jurisdiction of the Court of Perugia (Italy).

The version in force at the time of the order shall apply.
